Divij Kishore, founding attorney of Flagship Law, has published a legal research article in the AILA Law Journal, one of the leading academic publications in immigration law. His article, titled “Executive Innovation and Statutory Constraint: The Legal Viability of the Trump Gold Card,” examines the legal and constitutional questions surrounding the proposed Trump Gold Card immigration program.
Published in the April 2026 edition of the journal, the article explores whether the executive branch has the authority to create a wealth-based immigration pathway without direct congressional authorization under the Immigration and Nationality Act.
Kishore’s research analyzes how the proposed program differs from existing employment-based immigration pathways such as EB-1, EB-2, and EB-5, while also examining broader issues involving administrative law, executive authority, visa allocation, and constitutional limits on immigration policy creation.
The article appears in Volume 8, Number 1 of the AILA Law Journal, alongside scholarship covering asylum law, immigration detention, federal court litigation, and constitutional challenges within immigration enforcement.
